State Farm Looses Katrina Case in Federal Court - Industry Shocked
This Federal Court decision could be the start of many court decisions that will have an affect not only the victims of Katrina, but the denial of any claim where there is windstorm loss and resulting storm surge. The insurance industry is reported as surprised, but I (and several of the company employees I have talked to) believed that insurance companies would loose in court.
It has been my opinion that the cause of these looses was the wind of hurricane Katrina. There would be no storm surge without the high winds. There are exclusions in the Homeowners policy, but the courts have been consistent in that they have found in favor of the homeowner whenever there is ambiguity or “reasonable expectations of coverage” for property losses
